Privacy

Ombudsman Toronto will collect personal information from individuals who choose to make a complaint to our office about the City of Toronto.

The information is collected under the authority of the City of Toronto Act, 2006 and the Ombudsman Act, and with your prior consent, may be used by Ombudsman Toronto staff for the purpose of contacting the City in relation to your complaint.

If necessary, while looking into a complaint, Ombudsman Toronto may also collect personal information relating to identifiable individuals from organizations within the City.

Personal information collected by Ombudsman Toronto is kept confidential and is protected from disclosure. Ombudsman Toronto staff cannot be compelled to disclose information that comes to their knowledge in the course of their Ombudsman duties, subject to the requirements of the law.

Provisions of the City of Toronto Act, 2006 related to the protection of information collected by Ombudsman Toronto prevail over the Municipal Freedom of Information and Protection of Privacy Act.

Notice of collection

Ombudsman Toronto collects personal information under the legal authority of the City of Toronto Act, 2006, sections 170-176, the Ombudsman Act, section 19 and the City of Toronto Municipal Code, Chapter 3, Article 6, Ombudsman, sections 3-6.1 to 3-6.10. The information will be used to investigate concerns about the administration of the City, assess and resolve complaints, communicate updates and outcomes with complainants and may be shared with City organizations for the purposes of resolving complaints and making recommendations for improvement.

Ombudsman Toronto may also, from time to time, collect personal information without providing notice to the individual to whom the information relates, when this is necessary to protect the integrity or confidentiality of an investigation. In circumstances where the provision of notice to affected individuals would frustrate the purpose of collection, such as but not limited to, conducting the investigation in private as mandated by s.172 of the City of Toronto Act, 2006, or the obligation to preserve secrecy with respect to all matters that come to the knowledge Ombudsman Toronto staff in the course of their duties under s.173 of the City of Toronto Act, 2006,  notice of collection shall not be provided, as permitted by s.4 of R.R.O. 1990, Regulation 823.
